Program Topic: Maine House Approves bill removing unionizing rights for egg farm workers
Key Discussion Points:
a) On Tuesday, the Maine House passed LD 1207 “An Act to Amend the Labor Laws Relating to Certain Agricultural Employees”. This bill seeks to overturn legislation passed in 1997 to allow for egg workers in facilities with more than 100 workers and 500,000 laying hens the right to unionize. This, and a bill passed in 1975 to allow the same set of workers the right to a minimum wage standard and overtime, both aimed to temper the egregious working conditions at the Decoster egg farms in Turner.
b) Federally, the National Labor Relations Act excludes agricultural workers from the rights to a minimum wage standard, overtime or the right to collective bargaining . It is up to individual states to grant these rights. At least 9 states now allow some form of collective bargaining for agricultural workers.
c).Decoster is now leasing it&#8217;s Maine factories to Moark, LLC, a subsidiary of Land O&#8217; Lakes. The Maine Senate is expected to vote on LD 1207 as soon as next week. There is a lack of support for the bill, however, from both Democrats and Republicans.

Key Discussion Points:
a) Though not required of any other government agency, in 2006, Congress mandated that the US Postal Service pre-fund their future retiree health benefits. Meeting this mandate accounts for 84% of the postal service&#8217;s current debt, which a bill co-sponsored by Senator Collins and others asserts must lead to the closure of hundreds of post offices and processing centers through out the country, including 30 Maine post offices and the Hampden processing center.
b) LD 1798, “An Act to Reform Land Use Planning in the Unorganized Territory”, proposes to restructure and reassign the current make up and tasks of the Land Use Regulatory Commission (LURC). This includes : assigning the permitting of large scale projects to the Department of Environmental Protection, eliminating the requirement that the developer of a project demonstrate that there is a “need” for it.
c. LD 1798 would also change LURC&#8217;s name to the Land Use Planning Commission (LUPC) and would be made up of nine members, six from the counties with the largest amount of Unorganized Territories. Count Commissioners could appoint themselves to the LUPC. The most impacting on the current mission of LURC, the bill would allow counties to opt out of the LUPC, as the Natural Resources Council of Maine says, could effectively dismantle the statewide land use system.

Occupy Wall Street actions in Maine
Occupy Wall Street actions continue to spread across the country, and Maine. On Saturday, more then 150 people gathered on the steps of the capitol building in Augusta. That evening, more than 30 people camped out in the park across the street. Since Saturday, approximately 30 people have stayed each night. Each day, there is a demonstration on the capitol steps.
    Occupy Bangor will kick off on October 29th. The time and place to be announced after an organizing meeting this coming Monday.
    Blue Hill and Ellsworth are holding weekly Occupy Wall Street solidarity demonstrations : at noon on Saturday on the Blue Hill bridge and at noon on Sunday on the Ellsworth bridge.
   Occupy Maine in Portland continues, as well.
   On this program we hear from some of the participants in the Occupy Augusta on Saturday, an international day of Occupy Wall Street actions.
   And we speak with an Occupy Augusta activist who has been present at the encampment this past week.</itunes:summary>

Today we talk with Bangladeshi labor activist Kalpona Akter, who along with two of her colleagues were arrested last summer following their involvement in a movement to raise the minimum wage for garment workers in Bangladesh. The garment factory managers who have leveled charges against the three activists are major suppliers to Walmart.
Kalpona Akter, Babul Akter and Aminul Islam, all from the Bangladesh Center for Worker Solidarity, could face long prison terms, or even the death penalty, for some of the charges. A major international campaign has targeted Walmart to take responsibility for the labor conditions in the factories they outsource to, and to pressure the factory owners to drop charges against the activists advocating for better working conditions in these factories.

This week, the heads of the Passamaquoddy, Penobscot, MicMac, Maliseet and Maine state governments signed a Declaration of Intent to Create a Maine/Wabanaki Truth and Reconciliation Process. This process will create a commission to address the damaging history  and repercussions of federal and state child welfare practices on the Wabanki tribes. This process is the first of its kind in the U.S.
   An excerpt of the declaration reads:
   “Beginning in the late 1800’s, the United States government established boarding schools intended to solve the “Indian problem” through assimilation. Henry Richard Pratt, the founder of the Carlisle Indian Industrial School, described his effort as an attempt to “kill the Indian and save the man”. In the 1950s and 1960s, the Bureau of Indian Affairs and the Child Welfare League of America created the Indian Adoption Project which removed hundreds of native children from their families and tribes to be adopted by non-native families. In 1978, the US Congress passed the Indian Child Welfare Act (ICWA), which codified higher standards of protection for the rights of native children, their families and their tribal communities. Within the ICWA, Congress stated that, “No resource is more vital to the continued existence and integrity of Indian tribes than their children” and that “Child welfare agencies had failed to recognize the essential tribal relations of Indian people and the culture and social standard prevailing in Indian communities and families.”
     Important progress has been made with the passage of ICWA. There has been positive collaboration between the state of Maine and Wabanaki tribes to bring lasting positive change. Since 1999, this effort has resulted in ICWA trainings for state workers, an Indian Child Welfare policy and a better working relationship.
  In spite of this progress, Maine  child welfare history continues to impact Wabanaki children and families today. We have come to realize that we must unearth the story of the Wabanaki people’s experiences in order to fully uphold the spirit, letter and intent of the ICWA in a way that is consistent and sustainable.”
   We speak with Esther Attean, Passamaquoddy tribal member. She is with the Muskie School of Public Policy and part of the convening group for the Truth and Reconciliation Commission.
  We also talk with Denise Yarmal Altivator, Passamaquoddy tribal member. She is a commissioner with the Maine Indian Trial State Commission and a member of the convening group.

Segment 1:  Supporters of Maine-certified medical marijuana user Jeffrey Barnard plan to gather at the Federal Courthouse in Bangor Tuesday morning to ask Judge Woodcock to release Barnard, and to let him resume using marijuana.  They say he has been a  victim of a conflict between Maine&#8217;s medical marijuana law, and federal probation policies prohibiting use.   We spoke with his wife, Vicki Barnard, and a family friend, Jeff Black, earlier today:

Today we discuss five pesticide bills before the Maine legislature&#8217;s Joint Standing Committee Agriculture, Conservation and Forestry. Two bills being considered would essentially erase recently passed legislation. One would repeal the pesticide registry, which requires landowners to inform residents, within a certain distance, at the beginning of the season, that they can get on a list for aerial and air carrier pesticide spray notification. The second, would severely limit the distance within which landowners would be required to observe notification wishes, cutting it from a quarter mile to 100 feet.
Another bill before the committee seeks to restrict the use of herbicides and pesticides on the grounds of schools and childcare facilities.
This News Just In: The Maine Superior Court has just ruled to vacate the Land Use Regulatory Commission&#8217;s decision to grant Plum Creek&#8217;s development plan for the Moosehead Lake region. Attorney Phil Worden represented the Forest Ecology Network and RESTORE: The North Woods in this challenge to LURC&#8217;s decision. Chief Justice Humphrey called LURC&#8217;s action an “unauthorized, ad hoc procedure,” and concluded that the public was denied its legal rights to speak out on the final version of Plum Creek’s plan.  </itunes:summary>

Segment 1: We  talk with labor historian Charles Scontras, in the wake of the labor history mural removal from the Me. Dept of Labor, on Caesar Chavez Day. 
  In Maine, Governor Paul LePage&#8217;s active purging of labor history observations from the Maine Dept of labor building, includes not only taking down the mural depicting scenes from Maine&#8217;s labor history, but also orders the renaming of the rooms of the rooms in the Department of labor, one of which is named after Caesar Chavez. Another is named after Frances Perkins, the first woman to serve in a US Cabinet post and the longest serving of any member.  Among the many scenes of labor history depicted on the mural painted by the artist Judy Taylor is a panel of Frances Perkins.
 Dr. Charles Scontras, the labor historian that worked with Judy Taylor on what history to represent in the mural. Scontras is a retired professor from the University of Maine at Orono&#8217;s department of political science, history and modern society. He now works as a historical and research associate with the Bureau of Labor Education.  Maine is currently embroiled in another such “right to work” effort, which would undermine the capacity of unions.

  A rally and press conference to demand the return of the Maine labor history mural to the Maine Dept of Labor has been rescheduled due to expected weather. It will take place Monday, April 4th at the hall of Flags at the Augusta State House at noon.
Segment 2: We spoke earlier with Mike Belliveau, the executive director of the statewide public health organization, the Environmental Health Strategy Center.
He spoke with us about the recent unanimous vote by the Energy and Natural Resources Committee to support a ban on Bisphenol-A in products used by children in Maine, LD 412. he also discusses a proposed bill, whose intention is to essentially gut the Kids Safe Products Act.

Today we examine the court challenge to the Plum Creek Development plan.
We talk with Phil Worden. He is the attorney for Forest Ecology Network and RESTORE: The Maine Woods, who are fighting to repeal the Land Use Regulatory Commission&#8217;s approval of the massive development plan in the Moosehead Lake region, which would include 1000 house lots and 2 large resorts. The development required the rezoning of close to 16,000 acres. Included in the proposal is the setting aside of approximately 600,000 acres for so-called conservation, though commercial logging and gravel and water extraction would be allowed there.
Initially, the Land Use Regulatory Commission was not satisfied with Plum Creek&#8217;s plan, and made changes before they approved it. They did not, however, re-open the new plan to the public adjudicatory hearing, which allowed interested parties to cross examine and present their own arguments. This is one of the main points of the suit. On February 24th, the Maine Superior Court heard final arguments on the merits of the case.</itunes:summary>

Today we hear about a new study on who in Maine receives TANF &#8211; the Temporary Assistance for Needy Families- and why.
On Tuesday researchers, advocates and recipients of TANF will present a study titled “Families in Focus-Moving beyond Anecdotes : Lessons for Legislators from a 2010 Survey of TANF Recipients”. The LaPage administration has indicated state social services will be examined for cuts, and has expressed the intention to limit the time period a state resident can receive assistance. The Maine Heritage Policy Center, a conservative think tank working closely with the administration, has also taken target at the state’s poverty program recipients. Today we hear from Anna Hickes with Maine Equal Justice Partners and Sarah Standiford with the Maine Women’s Lobby.
What are the findings of the study “Families in Focus-Moving Beyond Anecdotes: Lessons for Legislators from a 2010 Survey of TANF Recipients” ?  What are some concerns about the direction the LePage administration in poverty programs, including limiting the time someone can be on TANF?  What are some of the experiences of individuals, particularly women and children, on TANF? What are common struggles?
